Free transport in Guanacaste

This Regulation (hereinafter the “Regulation”) aims to establish, define, and limit the terms and conditions of the promotion that will be carried out and organized by FERRETERÍA EPA S.A., legal entity identification number 3-101-354271, hereinafter and for the purposes of this Regulation referred to as “The Organizer” and/or Ferretería Epa S.A / EPA.”

The provisions herein shall be mandatory for Customers (see definition of Customer below) participating in said Promotion. Participation in the Promotion implies the Customer's acceptance of and compliance with these rules, limitations, and procedures, which shall be considered definitive regarding the Promotion, and are known and accepted as such. Any violation of these rules and/or procedures established for the Promotion will imply the immediate exclusion of the Customer or Participant, without any liability on the part of Ferretería EPA S.A.

The following capitalized terms and definitions used in this Regulation shall have the meaning established herein, with the understanding that such meaning shall apply to both the singular and plural forms thereof.

• “Customer or Participant” means any individual who participates in the Promotion within the limitations of this Regulation.

• “Points of Sale” means the Ferretería EPA stores located in Curridabat, Escazú, Belén, Tibás, and Desamparados, and sales channels for customers in the Corporate Sales portfolio.

• “Personal Data” means the data that each Customer must provide and complete in the documentation to apply for the benefit, which are (i) Full Name; (ii) Valid and current personal identification number, duly recognized by the Government of the Republic of Costa Rica; (iii) Phone numbers; (iv) email address. Such information will be used solely by the Organizer for the purposes of the Promotion, a situation to which customers consent; therefore, it may not be used for commercial or advertising purposes.

• Prize and/or benefit: In this promotion, the benefit and/or prize shall consist of free and/or included transport to Guanacaste for the purchase of products, subject to the exceptions set forth in this regulation.

Article 1. Validity and Application of the Offer or Special Promotion:

The promotional benefit offered in this promotion consists of free or included transport service, corresponding solely and exclusively to purchases made during the validity period of the promotion, which is of limited duration, starting on November 1, 2024, and ending on March 31, 2025, during regular EPA business hours.

Therefore, all applicable purchases must be coordinated with the Corporate Sales department and with the identified personnel of Ferretería EPA S.A. who are effectively trained in this program by Ferretería EPA S.A.

Validity of the benefit:

The service will apply to all sales during the validity period described in this regulation. Purchases made outside the term or dates established in this Regulation will not have the benefit of “free or included transport service.”

Free or included transport is understood as the Customer not having to pay any sum in addition to the sale price of the product for the transport service; however, the customer must assume costs not contemplated in this Regulation.

Article 2. Conditions:

The service will apply to all customers who make a purchase with no minimum amount during the validity period of the promotion.

It is stated and hereby informed that all transport will be carried out only on Wednesdays during the validity period of the promotion, with Wednesday, March 27, 2025, being the last date for deliveries. The cutoff for deliveries will be Mondays at noon.

The customer must ensure that the address provided has access for a Tandem-type truck to enter in order to enjoy the benefit, and deliveries are made to the side of the truck (as far as it can access).

Items such as concrete blocks and cement have a maximum of 2 pallets per order or Customer, and the promotion does not include delivery of aggregates to the area.

The customer must be present or leave someone authorized to receive and sign in their place; otherwise, the merchandise will be returned and the customer must pick it up at the store. Deliveries are made via routing between 8 am and 5 pm; no fixed time is established for delivery.

The customer must sign a document acknowledging receipt of the material once the merchandise arrives, confirming satisfaction with the delivery.

Any discrepancy detected for which a warranty is desired must be presented at the Ferretería EPA store where the purchase was made, with the product in perfect condition and the original invoice.

At all times, the customer must keep the product purchase invoice and the required materials to be able to apply for a warranty.

Responsibility of the company transporting the merchandise:

The personnel providing the transport service are trained to transport merchandise for all products sold in Ferretería EPA stores.

The availability of dates and times for delivery is subject to the number of previously coordinated shipments and the number of vehicles available for delivery; therefore, all purchases must be coordinated with the Ferretería EPA advisors in the Corporate Sales department.

Article 3. Coverage Range: The free or included transport service applies only to natural or legal persons affiliated with the Corporate Sales portfolio.

Limitations and Conditions:

Includes:

• Delivery of materials through the free transport service.

Does Not Include:

• Does not include installation, site visits, or consulting at the time of merchandise delivery.
• Transport of aggregates to the area.

Article 4.Illustrations and Photographs: The illustrations or photographs used in the publication of the free transport service offer or promotion are for illustrative purposes only; however, they clearly reflect the benefit granted in the Promotion to the consumer. The size, design, and dimensions of the product on offer or promoted may vary according to the inventory in each store, all of which conforms to the product codes participating and described above.

Article 5.Suspension or Modification of the benefit: Ferretería EPA S.A. may modify, suspend, or terminate any free transport service benefit, offer, or promotion early and immediately, without any liability on its part, totally or partially, indefinitely or definitively, if any force majeure or act of God occurs that justifies it. Likewise, for commercial or convenience reasons, it may also modify, suspend, or terminate any offer or promotion on the same terms, at its sole discretion, without the need for prior notice other than that published at the customer service offices in each of the Ferretería EPA stores.

Article 6. Non-compliance: Any violation of this regulation and/or the procedures and systems for applying the benefit, Promotion, or Special Offer will imply the immediate exclusion of the consumer from participating in the Benefit, Promotion, or Offer and/or the revocation of the purchase of Products under the corresponding Benefit, Promotion, or Offer.

Article 7. RESTRICTIONS AND LIMITATION OF LIABILITY:

a): EPA may modify, reduce, expand, extend, suspend, or terminate this Promotion early and immediately, without any liability on its part, totally or partially, indefinitely or definitively, if any force majeure or act of God occurs that justifies it. Likewise, for commercial or convenience reasons, it may also modify, suspend, or terminate this Promotion on the same terms, at its sole and absolute discretion, without the need for prior notice other than that published in the media and advertising deemed appropriate by the Sponsor, or at its Customer Service offices.

b): EPA's liability ends with the delivery of the benefit, and it is not responsible for any type of accidents, death, illness, or medical expenses, conduct, or misconduct that may occur through the use and enjoyment of any of the prizes or products acquired, as well as the transport provided.

c): In special cases that justify it, at the Sponsor's decision, a Notarial Act will be drawn up regarding these circumstances to certify any fact beyond what is provided in this Regulation.

d): In the event that the beneficiary voluntarily indicates that they do not want to complete the transport process regulated by this Regulation, or by their own will does not accept the benefit, they may not claim any indemnification or consolation prize from the Organizer.

• The Promotion and the Participants are subject to the requirements, conditions, and restrictions of this Regulation.
• In any situation of act of God or force majeure, Ferretería Epa S.A. may suspend the Promotion totally or partially, without generating any liability for said suspension.
• Ferretería Epa S.A. will not be responsible for collateral expenses incurred by the Participant in carrying out the steps to make this Promotion effective. These collateral expenses refer to: cost of calls, preparation of documents, copies, cost of additional transport to the indicated point, or upon completing the maximum route, among others.
• Ferretería Epa S.A. reserves the right to suspend the benefits of this Promotion in cases where it is determined that its benefits have been applied through deceit, fraud, or other illegal activity.
• The mechanics of this Promotion, as well as the Intellectual Property derived from it, are the exclusive property of Ferretería Epa S.A.
• Ferretería Epa S.A.'s liability ends with the transport and delivery of the corresponding Prize to the Participant; therefore, the organizer is responsible only for the delivery of the benefit indicated in this Regulation.
• The winner of the prize and/or benefit will be solely responsible for the use and enjoyment they give to it.
• The Organizer will not be responsible for eventual unauthorized human interventions by third parties to computer systems or similar that alter the development of the promotion; therefore, if any such situation is detected, the Promotion will be suspended.
