Official rules for the “Dad, paint and win with LANCO” promotion

This Regulation (hereinafter the “Regulation”) aims to establish, define, and limit the terms and conditions of the promotion that will be carried out and organized by FERRETERÍA EPA S.A., corporate identification number 3-101-354271, who shall hereinafter and for the purposes of this Regulation be referred to as “The Organizer” and/or Ferretería Epa S.A / EPA”.

The provisions set forth herein shall be mandatory for Participants (see definition of Participant below) who voluntarily and in compliance with these provisions decide to participate in the Promotion carried out by EPA. Participation in the Promotion implies that the Participant acknowledges and respects these rules and procedures, which shall be considered definitive regarding the Promotion and are known and accepted as final. Any violation of said rules and/or procedures established for the Promotion will imply the immediate exclusion of the Participant, without any liability on the part of Ferretería EPA S.A.

By virtue of the foregoing, by the mere act of participating in the Promotion, Participants unconditionally accept all the rules of this Regulation, including those clauses that limit the liability of the Sponsor. Likewise, they agree to submit to the decisions of the Organizer on any matter related to the Promotion.

The granting of any of the prizes shall be conditioned upon compliance with each and every applicable law and regulation, as well as the provisions of this Regulation. The Organizer reserves the right to disqualify and/or demand the return of the prizes and/or benefits granted to those participants who directly or indirectly breach the rules and conditions established herein.

SECTION A. GENERAL PROVISIONS:

Article A1: Regarding the Promotion: The purpose of this Regulation is to establish, regulate, limit, and clarify the guidelines and/or conditions under which the Promotion titled “Dad paints and wins with LANCO” (hereinafter referred to as the “Promotion”) will be governed, which belongs to and is primarily sponsored by Ferretería EPA S.A. (hereinafter referred to as the “Sponsor” and/or the “Organizer”).

Article A2: This Promotion is for a limited time, beginning at 07:00 hours on June 15, 2021, and ending at 21:00 hours on July 15, 2021, a period during which this Regulation shall be in effect.

Article A3: All natural persons who wish to do so may participate in this Promotion, provided they are of legal age and possess a valid and up-to-date personal identification document, duly recognized by the Government of the Republic of Costa Rica.

Article A4: The Promotion is directed at Final Consumers of Ferretería EPA S.A. Therefore, manufacturers, distributors, resellers, and other persons considered as such may not participate in this Promotion. Likewise, collaborators and representatives of the Sponsor and any Co-sponsor that joins and is identified during the Promotion may not participate in the Promotion, up to the first degree of consanguinity or affinity. In this sense, all collaborators of Ferretería EPA S.A. are also prohibited from participating in the Promotion.

The Organizer reserves the right to disqualify from the Promotion or to demand the return of prizes granted under this Regulation when there are well-founded reasons to believe that the participant is not acquiring products for their personal use or that of their family circle, with the intention of reselling or distributing them, or with the intention of acquiring the participating items for the sole purpose of participating in the Promotion and subsequently returning said products before the expiration of the term thereof.

The fact that a person participates (3) times per day, which exceeds what is significantly reasonable or expected of an average contestant, will lead the Organizers to presume that their participation has been manipulated for the purpose of increasing their probability of winning. Therefore, they shall be disqualified from the promotion.

Article A5: The following terms capitalized and definitions used in this Regulation shall have the meaning established with the understanding that such meaning shall be applicable to both the singular and plural form thereof.

1. “Customer or Participant” means any natural person participating in the Promotion with the limitations of Articles A3 and A4 of this Regulation.

2. “Points of Sale” means the five (5) Ferretería EPA stores or purchases made through the website epaenlinea.com. The stores are located at: (i) Curridabat, adjacent to the Indoor Club; (ii) Escazú, adjacent to the Próspero Fernández highway; (iii) San Antonio de Belén, diagonal to the Mall Real Cariari; and (iv) Tibás, three hundred meters West of the intersection to Llorente. (v) Desamparados, three hundred meters south of the San Miguel intersection; (vi) Online store, official website cr.epaenlinea.com.

3. “Personal Data” means the data that each Participant must provide when registering the invoice, which are (i) Full Name; (ii) Valid and up-to-date personal identification number, duly recognized by the Government of the Republic of Costa Rica; (iii) Telephone numbers; (iv) Email address; (v) Purchase receipt number.

4. Prize: Five (5) purchase orders for one hundred thousand (100,000) colones in Lanco products, which will be distributed among 5 selected winners.

Prize Generalities: Each prize will be awarded through a random drawing, as a credit in favor of the customer to be used at Ferretería EPA exclusively on products of the brand LANCO, called a Claim, and the selected winner will have a period of 30 days after being notified as a winner of the promotion to claim the prize.

Article A6: For more information or queries about this Regulation, you can call the phone number 800 EPAVALE (800-372 8253). This Regulation will be available in its entirety for the knowledge and information of the general public and consumers in the Customer Service sections of the sponsor's Points of Sale during the term of this promotion. For the purposes of communicating this Regulation, the promotional material will establish the following legends: “Promotion valid from 6/15/21 to 7/15/21. Conditions apply. See regulation at epaenlinea.com”

SECTION B. PARTICIPATION MECHANICS AND CONDITIONS:

Article B1: To participate in this Promotion, it is necessary that the Participant know and accept in advance the conditions, requirements, and limitations established in this Regulation, which will be explained if necessary by the properly identified Ferretería EPA service advisors. Likewise, this Regulation will be available at Customer Service and in the regulation section within epaenlinea.com. Any violation of this Regulation and/or the procedures, mechanics, and application systems of the Promotion will imply the immediate exclusion of the Participant from the Promotion and the revocation of any right or prize granted.

Article B2: During the validity period of this Promotion, duly delimited in Article A2 of this Regulation, those interested in voluntarily participating in the Promotion may do so in the manner described in the following Articles.

Article B3: During the term of this Promotion, Participants who wish to participate in the drawing will do so as follows:

For a minimum purchase of thirty thousand (30,000) colones in gallons and/or buckets of LANCO brand paint exclusively at Ferretería EPA, the customer will automatically obtain the right to register their invoice through the website by filling out all the requested data via a digital survey. In this way, the customer will be participating in a drawing to win one of five possible prizes detailed in Article A5, subsection 4 of this regulation.

Epa personnel will verify the registered purchase once the promotion ends, validating that the sales receipt meets all the minimum requirements established above. The customer may participate by making their purchase and registering all the requested data on the website, including the barcode number of the original purchase invoice, which is detailed at the bottom of the original invoice; therefore, it must be understood that to be eligible for the opportunity to participate in the drawing, it will be solely and exclusively for those customers whose invoice contains one or more of the aforementioned LANCO brand products in an amount equal to or greater than thirty thousand (30,000) colones purchased at Ferretería EPA during the promotion period and who have registered their invoice correctly.

Article B4: Conditions to participate.

• The customer must access the website cr.epaenlinea.com/promooff via the internet, with the original purchase invoice, and register their invoice data, along with all their participant data, provided they meet the mentioned requirements.
• Each invoice may be registered only once; duplicate invoices will be automatically discarded prior to the drawing.
• It is stated that any participant who returns the products acquired through the purchase invoice with which they completed the requirements to obtain the prize will be excluded from being a beneficiary of the prize. The foregoing will be verified at the time of checking the invoice number in the system.
• Non-original, torn, damaged invoices, records with false or incorrect data, or any that fail to comply with the procedures established for that purpose, or that raise doubts about their authenticity, will not participate.
• Invoices that were purchased in the correct period but were registered outside the promotion's validity date will not participate.

Article B5: Those customers who do not meet one or more of the requirements indicated in this regulation will be excluded as participants. Likewise, if the data provided is not clear and does not allow for the identification of the Participant.

Article B6: Each person favored with a prize according to Article B3 of this Regulation, as established in the Regulation, will have their purchase included in the promotion database instantly once the invoice is registered and all requirements are met, allowing them to participate for the prize. The prize cannot be transferred, cannot be exchanged for cash, and the withdrawal date will be coordinated with the winner.

Each Participant must register their invoice within the promotion period, so the deadline for the correct registration of the invoice will be July 15, 2021. Failure to do so will result in the loss of the right to the same, and they will not be able to claim the loss of said prize from Ferretería EPA S.A.

In the event of having accepted a prize but, for any circumstance, refusing to receive it or to complete the respective paperwork, the favored person will lose their right to the Prize. A Notarial Act regarding these circumstances will be drawn up at the discretion of the Organizer.

In the event of having accepted a prize and detecting any malfunction, the favored person may return the prize under warranty. In this case, the prize will be exchanged for another one of the same type; in the event that the prize mentioned in Article A5 is not in stock, the value of the prize established in the same Article A5 will be delivered in colones.

Article B7: In order to publicize the results of the Promotion, at the decision and discretion of the Organizer, the participants who are favored with any of the Prizes of this Promotion irrevocably and expressly authorize the Organizer to have their name and image appear in publications and other advertising media and, in general, in all disclosure material for activities subsequent to the Promotion, such as the delivery and receipt of the prizes, without implying additional remuneration or compensation, nor claims for image rights; therefore, by participating, they adhere to the regulations of this Regulation and may not refuse the disclosure of their information and image rights.

SECTION C. DRAWING PROCEDURE AND PRIZE WITHDRAWAL:

Article C1: Once the promotion has concluded, all registered invoices that participated throughout the promotion's validity as delimited in this regulation will be compiled.

Article C2: 5 winners of the prizes indicated in this Regulation will be selected from among all those who participated, in a random drawing to be held on July 20, 2021, at the headquarters of Ferreterías EPA. The drawing will be carried out by those in charge of the Marketing Department. Said drawing will be held in the presence of the person in charge of the promotions department along with two (2) witnesses, and an affidavit will be drawn up endorsing the random nature of the drawing, as well as the five (5) selected winners of the Prize and the ten (10) alternate winners. The Organizer reserves the right to modify the mentioned date of the drawing for convenience, provided that the possibilities of each participant being favored are not modified.

Article C3: Subsequently, the correct participation of the selected winner will be verified; in case they do not comply, they will be automatically discarded, and the correct participation of the first alternate will be verified, following the same protocol, and so on until the alternate winners are exhausted. In the event that the participation meets all requirements, the winner will be contacted via a telephone call within a maximum period of (3) business days. In case of not locating the selected person within a maximum of 3 call attempts during this period, the next corresponding alternate winner will be contacted following the same protocol, and so on until the alternate winners are exhausted. Once one of the selected persons is confirmed as a winner, the announcement of the winner will be made; in case no selected person meets the established criteria, the selection of the winner for the prize will be considered void, and the prize will remain at the disposal of the organizer.

Article C4: The winners will be announced starting approximately July 27, provided that everything mentioned in this article has been verified; otherwise, the organizer reserves the right to modify the announcement date until all the data necessary for publication have been correctly verified. The winner will be announced solely on the “EPA Costa Rica” Facebook page in a post on the wall.

Article C5: After the aforementioned Drawing has been held and the respective favored person and/or winner of the prize has been identified, in accordance with the previous Articles of this Regulation, once the winner is contacted following the procedure by an EPA representative, they will be informed of the place, date, and time for delivery, as well as the procedure they must follow to withdraw the corresponding Prize. In this sense, the winner must sign a receipt for their prize, as well as a liability release document for Ferretería EPA S.A., where all the limitations and conditions that the granted Prize entails will be expressed, releasing the Sponsor from all liability for its use and/or consumption. Likewise, the favored winner may not claim or request from Ferretería EPA S.A. any additional expense generated by the withdrawal of the Prize, such as transport or the cost associated with it in case they do not have the necessary means to transport and/or install it in the place they freely choose.

Article C6: The Winners must withdraw their Prize within a period of no more than 1 month from the moment they are contacted by Ferretería EPA S.A. collaborators at the hours, days, and place established by the organizer to withdraw the Prize; these details will be shared with the winner once confirmed.

Failure to do so shall result in the forfeiture of the right to the Prize, with no claim for damages and/or losses being permissible against Ferretería EPA S.A. as a result of the loss of the Prize. Said Prize may NOT be assigned under any circumstances to a family member, spouse, child, or third party, as the purpose of the promotion is for the participant who correctly registered the invoice and provided their data to be the beneficiary of the Prize. Likewise, the selected Participant freely and spontaneously authorizes Ferretería EPA S.A. to use their image rights and name in promotional campaigns and any type of advertising carried out by Ferretería EPA S.A., without being able to request any remuneration for it.

Article C7: In the event that the Prize has been accepted, but for any circumstance the Participant refuses to receive it or to complete the respective paperwork for formalization, the winner will forfeit their right to the Prize. A Notarial Act regarding these circumstances may be drawn up at the discretion of the Organizer. The granting of any of the prizes shall be conditioned upon compliance with each and every applicable law and regulation, as well as compliance with the provisions of these Regulations. The organizer reserves the right to disqualify and/or demand the return of prizes granted to those participants who directly or indirectly breach the terms and conditions established herein. If the winner does not demonstrate their willingness to accept these conditions, the organizers will not assume any type of responsibility, exonerating themselves from the obligation to allow participation and the delivery of a prize or benefit.

SECTION D. RESTRICTIONS AND LIMITATION OF LIABILITY:

Article D1: The illustrations and/or photographs used in the publications of this Promotion are solely for commercial purposes; however, the items corresponding to the prize correspond to the reality and characteristics thereof specified in Article A5, point 4.

Article D2: The Sponsor may modify, reduce, expand, extend, suspend, or terminate this Promotion in advance, immediately, without any liability on its part, in whole or in part, indefinitely or definitively, if any cause of force majeure or fortuitous event occurs that warrants it. Likewise, for commercial reasons or convenience, it may also modify, suspend, or terminate this Promotion under the same terms, at its sole and absolute discretion, without the need for prior notice other than that published in the media and advertising channels the Sponsor deems convenient, or at its Customer Service offices.

Article D3: The Sponsor's liability ends with the delivery of the prizes described in Article B4 and it is not responsible for any type of accidents, death, illness, or medical expenses, conduct, or misconduct that may occur through the use and enjoyment of any of the prizes or promotional products.

Article D4: If a selected Participant does not appear to redeem their prize within the period indicated in these Regulations, within the dates indicated, as well as within the corresponding period of 1 month after their notification as a winner, their right to claim the prize shall be considered a voluntary waiver. The selected Participant will not be entitled to any claim or compensation, not even partially, which each Participant accepts by voluntarily adhering to participation in the promotion. Should such a situation arise, the Organizer is authorized to select one of the alternate winners as appropriate, provided they meet the minimum established requirements; otherwise, the prize will remain at the disposal of the organizer.

Likewise, in special cases that warrant it, at the Sponsor's decision, a Notarial Act will be drawn up regarding these circumstances to record any fact outside of those provided for in these Regulations.

Article D5: In the event that a Participant is selected as a Winner and for any reason, whether they do not meet the restrictions and conditions regulated herein, or by their own will do not accept the Prize, they may not claim any compensatory sum or consolation prize from the Organizer.

• The Promotion and the Participants are subject to the requirements, conditions, and restrictions of these Regulations.
• In the event of any fortuitous event or force majeure, Ferretería Epa S.A. may suspend the Promotion in whole or in part, without generating any liability for such suspension.
• Ferretería Epa S.A. will not be responsible for collateral expenses incurred by the Participant in carrying out the proceedings to make this Promotion effective. These collateral expenses refer to: cost of calls, preparation of documents, copies, cost of transportation, among others.
• Ferretería Epa S.A. reserves the right to suspend the benefits of this Promotion in those cases where it is determined that the benefits thereof have been applied through deceit, fraud, or other illegal activity.
• The mechanics of this Promotion, as well as the Intellectual Property derived therefrom, are the exclusive property of Ferretería Epa S.A.
• The liability of Ferretería Epa S.A. ends with the delivery of the Prize to the favored Participant, so the organizer is responsible solely for the delivery of the prize indicated in these Regulations. EPA will not be responsible for damages to persons.
• The prize winner will be solely responsible for the use and enjoyment they make of it.
• The Organizer will not be responsible for any unauthorized human intervention by third parties in computer systems or similar that alter the development of the promotion; therefore, if any such situation is detected, said Promotion will be suspended.
• Suspension of the Promotion: The Organizer reserves the right to suspend the Promotion temporarily or definitively in the event that the existence of fraudulent prize allocation or claims is proven, as well as in cases of technical failures or any other event beyond the reasonable control of the Organizers. The alteration of documents and information about the Participants, as well as deceit, fraud, or falsification, unauthorized manipulation that hinders the normal performance of the Promotion, and actions that in the opinion of the Organizers are illegal and may cause prejudice to the Promotion or its Organizers may be prosecuted by the means provided for by Law.
• Personal Information: All information provided by the participants will belong to the Organizer and/or Co-organizer. Participants, by providing their data, authorize access to said information by the Organizers and its inclusion in a database if the Organizer deems it appropriate, also authorizing the use of said database to send commercial information from the Organizing Company or third parties, as well as any commercial purpose that is not prohibited.
• Relationship between the parties: No provision of this Promotion shall be interpreted as creating a relationship between the parties different from that which arises from normal trade traffic. No participant of the Promotion, by the mere fact of being one, acquires the status of employee, representative, or agent of the Organizing company. Compliance with the obligations established in these Regulations will end the relationship between the parties in its entirety.
• Participants acknowledge that the Organizer will not collect or process sensitive personal data. The data requested from the participant and which the law empowers the Organizer to request will be used. Participants, by the mere fact of participating, accept and consent that the data relating to their names, photographs, and personal emails that they have on their Facebook social network profiles or provided at any time during the Promotion may be used by the Organizer.
• Regarding respect for the right to information self-determination that assists individuals, the Organizer informs all Promotion participants of the existence of a database where the personal data requested in this Promotion, email address, and telephone number will be collected.
• The information contained in the database that may be held by the Promotion will be for the use of the Organizer, and the Organizer is authorized to transfer such data to the company(ies) it deems pertinent. Participants and users declare that they have been informed of the conditions regarding the protection of personal data described above, accepting and consenting to the automated processing thereof by the Organizer, in the form and for the purposes indicated in this section.
