Official Rules for the "Grill Giveaway" Promotion

This Regulation (hereinafter the “Regulation”) aims to establish, define, and limit the terms and conditions of the promotion to be carried out by FERRETERÍA EPA S.A., legal entity identification number 3-101-354271, which shall be referred to hereinafter and for the purposes of this Regulation as "The Organizer" and/or "Ferretería EPA S.A.".

The provisions herein shall be mandatory for the Participants (see definition of Participant below) in said Promotion. Participation in the Promotion implies the Participant's acceptance of these provisions. Any breach of this Regulation implies the immediate exclusion of the Participant, without any liability on the part of Ferretería EPA S.A.

ARTICLE ONE: GENERAL PROVISIONS AND NAME OF THE PROMOTION.

The name of this Promotion shall be “GRILL GIVEAWAY,” which shall be referred to hereinafter and for the purposes of this Regulation as the “Promotion.”

The Regulation of the Promotion will be published in the Regulations section of Ferretería Epa on Epaenlinea.com, without prejudice to Ferretería EPA S.A. freely choosing any other additional advertising medium to promote it.

The purpose of this Regulation is to establish and regulate the guidelines and/or conditions that will govern the giveaway of a Char-Broil grill.

The Promotion shall be governed by the conditions indicated below. By the mere fact of participating in the Promotion, Participants accept the rules established in this Regulation, including those clauses that limit the liability of the Organizers, which have been duly informed to the Participant.

ARTICLE TWO: DURATION OF THE PROMOTION

The promotion will be valid from Friday, June 5, 2026, starting at 7:00 am, until Sunday, June 14, 2026, at 9:00 pm.

ARTICLE THREE: OBJECTIVE OF THE PROMOTION

To participate and be a beneficiary of the Promotion, it is necessary for the Participant to be aware of and accept the conditions and requirements established in this Regulation, which may be explained in a general manner by the Promotion Manager of Ferretería EPA. Likewise, the Participant and any interested party may make inquiries via the email address promociones@cr.epa.biz. Any breach of the Regulation and/or the procedures, mechanics, and application systems of the Promotion implies the immediate exclusion of the Participant from the Promotion and the revocation of any right or prize granted.

Persons interested in participating in the Promotion may do so under the modality described in the following articles:

The objective of the Promotion is to offer the public the benefit of being selected as the winner of the prize of this Promotion, in accordance with the mechanics indicated below. The Participant must accept the terms and conditions of this Regulation.

The Promotion will take place in the physical stores of EPA Costa Rica. Any natural person who completes the survey on the posters located in various places within the establishment during the validity period will have the possibility to participate in the promotion.

ARTICLE THREE-A: PROMOTION MECHANICS

In addition to what is described above, the promotion will be carried out in the following way:

The customer must scan the QR code on the posters located in various points of the establishment and answer the survey to which said QR redirects; by doing so, they will automatically be participating in the giveaway of a Char-Broil 20,000 BTU 2-burner gas grill.

The participant may only complete the survey once during the validity of the promotion.

Ferretería Epa S.A. reserves the right to demand from the Participant any additional document that may be necessary to apply for the Promotion. In accordance with what is regulated herein, during the validity period of the Promotion, Participants who wish to participate in the giveaway will do so in accordance with the mechanics expressed in this Regulation.

ARTICLE FOUR: DEFINITIONS

The terms indicated below shall have the meaning established, with the understanding that said meaning shall be applicable to both the singular and plural forms thereof.

1. “Customer or Participant”: Any natural person who participates in the Promotion with the limitations indicated in this Regulation.

2. “Point of Sale”: Each of the stores in Curridabat, Escazú, Belén, Tibás, Desamparados, and Cartago.

3. “Personal Data”: (i) Full Name (first and last names); (ii) Valid and up-to-date personal identification number, duly recognized by the Government of the Republic of Costa Rica; (iii) Phone numbers; (iv) Email address, in compliance with the legal provisions established by the "Law on the Protection of Individuals with Regard to the Processing of their Personal Data".

4. “Prize”: In this promotion, there is one (1) type of prize, which consists of a Char-Broil 20,000 BTU 2-burner gas grill.

ARTICLE FIVE: GIVEAWAY PROCEDURE AND PRIZE COLLECTION.

Once the validity period mentioned in this regulation has ended, the information of the Participants who meet the mentioned requirements will be compiled.

1 winner of the prize will be selected from all those people who have participated. The random drawing, for which the date and location will be provided, will take place on June 18, 2026, at the central offices of Ferretería EPA, S.A. An Affidavit / Sworn Statement will be drawn up before two (2) witnesses with the name of the winning participants and their respective alternates; in total, one (1) alternate will be selected per winner. This information may also be presented to a Notary Public so that they may certify compliance with the requirements and the process of the Promotion by drafting a Notarial Act. The organizer reserves the right to modify the date of the drawing as long as it does not modify the chances of being favored for any of the participants.

Then, the correct participation of the selected winner is verified. In the event that they do not meet the requirements, the selected person is disqualified and the first alternate is verified, following the same protocol, and so on until the alternate winners are exhausted. In the event that the entry meets all requirements, the favored winner will be contacted via a telephone call within a maximum period of one (1) business day. If the selected person cannot be reached after a maximum of 2 call attempts during this period, a voicemail message will be left, and the winner must contact the promotions department no later than the day following the voicemail message, through the Ferretería Epa switchboard at 2588-1145, from Monday to Friday, from 8 am to 3 pm. If the winner cannot be contacted after this, we will proceed to contact the next corresponding alternate winner following the same protocol, and so on until the alternate winners are exhausted. Once all winners are confirmed, the announcement of the winners will be made. The winner will be announced starting June 22, 2026, provided that everything mentioned in this article has been verified; otherwise, the organizer reserves the right to modify the announcement date until all necessary data for publication has been correctly verified.

After the Giveaway has been held and the person favored and/or winner of the prize has been identified in accordance with this Regulation, once a representative of Ferretería EPA S.A. has contacted the winner, they will be indicated the place, date, and time for the delivery and collection of the corresponding Prize. In this sense, the winner must sign the receipt of their prize, as well as a release of liability document for Ferretería EPA S.A., where all the conditions the Prize grants will be expressed, releasing the Sponsor from all liability for its use and/or consumption. Likewise, the favored winner may not claim or request any additional expense from Ferretería EPA S.A. generated by the collection of the Prize, such as transport or the cost associated with it in case of not having the necessary means to transport and/or install it in the place they freely decide.

If the conditions established in this Regulation are not met or if the necessary data verification of the official winner cannot be made, an alternate winner will be automatically chosen, and we will proceed with the data verification and prize delivery taking into account the specifications of this Regulation.

Failure to do so will result in the forfeiture of the right to the prize, and the winner will not be able to claim damages and/or losses from Ferretería EPA S.A. as a result of the loss of the Prize. Said Prize CANNOT be transferred, as the object of the promotion is that the fan and/or follower who made the comment and presented a valid identity card be the beneficiary of the Prize. Likewise, the favored Participant authorizes Ferretería EPA S.A., freely and spontaneously, to use their image rights and name in promotional campaigns and any type of advertising carried out by Ferretería EPA S.A., without being able to request any remuneration for it.

In the event that the Prize has been accepted and the Participant refuses to receive it or complete the respective paperwork for formalization, the favored party will lose their right to the Prize. A Notarial Act regarding these circumstances will be drafted at the discretion of the Organizer. The granting of any of the prizes will be conditional upon compliance with applicable laws and regulations, as well as compliance with the provisions of this Regulation. The organizer reserves the right to disqualify and/or demand the return of the prizes granted to those participants who directly or indirectly breach the terms and conditions previously established herein. If the winner does not demonstrate their willingness to accept these conditions, the organizers will not assume any type of responsibility, exonerating themselves from the obligation to allow participation and the delivery of a prize or benefit.

ARTICLE SIX: IMAGE USE AND FINAL PROVISIONS.

In order to make the results of the Promotion public, at the decision and discretion of the Organizer, the participant who is favored with the prize of this Promotion expressly authorizes the Organizer for their name and image to appear in publications and other advertising media and, in general, in all disclosure material regarding activities subsequent to the Promotion, such as the delivery and receipt of the prizes, without implying additional remuneration or compensation, nor claims for image rights. Therefore, by participating, they adhere to the regulations of this Regulation and cannot refuse the disclosure of their information and image rights.

It is noted that all illustrations and/or photographs used corresponding to the prize in the publications of this Promotion correspond to the reality of what is offered and promoted by Ferretería EPA. If the selected Participant does not appear to redeem their prize within the period indicated in this Regulation, it will be taken as a voluntary waiver of their right to claim the prize. The selected Participant shall not have the right to any claim or indemnity, not even partially, which each Participant accepts by voluntarily adhering to participation in the promotion. If such a situation arises, the Organizer is authorized to select an alternate winner as appropriate.

Ferretería EPA, S.A. will collect certain confidential information from the Participant, including but not limited to their personal data in accordance with the provisions of the “Law on the Protection of Individuals with Regard to the Processing of their Personal Data” and its Regulation. Therefore, at the time of selection as a Winner or Favored party, the Participant must sign all documents that the Organizer determines to authorize Ferretería EPA, S.A. to collect and, in general, use their data for the purpose of successfully communicating as a winner of the Promotion.

Likewise, in special cases that merit it, at the Sponsor's decision, a Notarial Act will be drawn up regarding these circumstances to attest to any fact not foreseen in this Regulation.

In the event that they are the Winner and for whatever reason—whether they do not meet the conditions regulated herein or they do not accept the Prize of their own free will—they may not claim any indemnification sum or consolation prize from the Organizer, as such is not regulated by this Promotion.

The Promotion and the Participants are subject to the requirements, conditions, and restrictions of this Regulation.

In the event of any case of fortuitous event or force majeure, Ferretería Epa S.A. may suspend the Promotion totally or partially, without generating any liability for said suspension.

Ferretería Epa S.A. will not be responsible for the collateral expenses that the Participant incurs to carry out the steps to make this Promotion effective. These collateral expenses refer to: cost of calls, preparation of documents, copies, cost of transport, among others.

Ferretería Epa S.A. reserves the right to suspend the benefits of this Promotion in cases where it is determined that its benefits have been applied through deceit, fraud, or other illegal activity.

The mechanics of this Promotion, as well as the Intellectual Property derived from it, are the exclusive property of Ferretería Epa S.A.

The responsibility of Ferretería Epa S.A. ends with the delivery of the Prize to the favored Participant, so the organizer is responsible only for the delivery of the prize indicated in this Regulation.

The winner of the prize will be responsible for the use and enjoyment they give to it.

The Organizer will not be liable for any unauthorized human intervention by third parties to computer systems or similar that alter the development of the promotion; therefore, if any such situation is detected, the Promotion will be suspended.
