Official Rules for the “Promotional Kit Giveaway” Promotion
This Regulation (hereinafter the “Regulation”) aims to establish, define, and limit the terms and conditions of the promotion to be carried out by FERRETERÍA EPA S.A., legal entity registration number 3-101-354271, which shall hereinafter be referred to as “The Organizer” and/or “Ferretería EPA S.A.” for the purposes of this Regulation.
The provisions herein shall be mandatory for the Participants (see definition of Participant below) in said Promotion. Participation in the Promotion implies the Participant's acceptance of the provisions. Any breach of this Regulation implies the immediate exclusion of the Participant, without any liability on the part of Ferretería EPA S.A.
ARTICLE ONE: GENERAL PROVISIONS AND NAME OF THE PROMOTION.
The name of this Promotion shall be “PROMOTIONAL KIT RAFFLE,” which shall hereinafter be referred to as the “Promotion” for the purposes of this Regulation.
The Promotion Regulation will be published in the Regulations section of Ferretería EPA on Epaenlinea.com, without prejudice to Ferretería EPA S.A. freely choosing any additional advertising medium to promote the raffle.
The purpose of this Regulation is to establish and regulate the guidelines and/or conditions that will govern the raffle of a promotional kit.
The Promotion will be governed by the conditions indicated below. By the mere act of participating in the Promotion, the Participants accept the rules established in this Regulation, including those clauses that limit the liability of the Organizers, which have been duly informed to the Participant.
ARTICLE TWO: TERM OF THE PROMOTION
The promotion will be valid from Wednesday, October 1st, starting at 7:00 am, until Friday, October 31st, at 11:59 pm.
ARTICLE THREE: OBJECTIVE OF THE PROMOTION
To participate and be a beneficiary of the Promotion, it is necessary that the Participant knows and accepts the conditions and requirements established in this Regulation, which may be explained in a general manner by the Promotions Manager of Ferretería EPA. Likewise, the Participant and any interested party may make inquiries to the email promociones@cr.epa.biz. Any breach of the Regulation and/or the procedures, mechanics, and systems of application of the Promotion implies the immediate exclusion of the Participant from the Promotion and the revocation of any right or prize granted.
Those interested in participating in the Promotion may do so under the modality described in the following articles:
The objective of the Promotion is to offer the public the benefit of being favored as the winner of the prize for this Promotion, in accordance with the mechanics indicated below. The Participant must accept the terms and conditions of this Regulation.
The Promotion will take place at all points of sale. In this sense, any natural person who makes a purchase of more than forty thousand colones (40,000), which includes a Christmas product, during the validity period will have the possibility to participate in the promotion.
ARTICLE THREE-A: MECHANICS OF THE PROMOTION
In addition to what is described above, the promotion will be carried out in the following way:
With a minimum purchase of 40,000 colones that includes a Christmas product, the customer participates in the raffle for one of the 6 Christmas kits (one per store), valued at 300 thousand (see list of prizes in Annex 1), and must provide their personal data on the invoice (name, identification number, phone number, email address).
Participants may make one (1) or more purchases; however, only one (1) purchase will remain eligible for the purpose of being favored in the raffle of this Promotion.
Ferretería EPA S.A. reserves the right to demand from the Participant any additional document that may be necessary to apply for the Promotion. In accordance with what is regulated herein, during the term of the Promotion, those Participants who wish to participate in the raffle will do so in accordance with the mechanics expressed in this Regulation.
ARTICLE FOUR: DEFINITIONS
The following terms indicated below shall have the meaning established, with the understanding that said meaning shall be applicable to both the singular and plural forms thereof.

“Customer or Participant”: Any of the natural persons who participate in the Promotion with the limitations indicated in this Regulation.

“Point of Sale”: Each of the stores in Curridabat, Escazú, Belén, Tibás, Desamparados, and Cartago, or on the website epaenlinea.com.

“Personal Data”: (i) Full Name (first and last names); (ii) Valid and up-to-date personal identification number, duly recognized by the Government of the Republic of Costa Rica; (iii) Phone numbers; (iv) Email address, in compliance with the legal provisions established by the “Law for the Protection of Individuals with regard to the Processing of their Personal Data.”

“Prize”: In this promotion, there is one (1) type of prize, which consists of a promotional kit that includes an Inflatable Snowman, a 1.6-meter train with light and music (22 pcs, 39.2x20.7x5.3), Windmill Ornament, Santa with Sleigh and Tree (9 pieces), Village 645, Village 369, Carousel, Traditional Nutcracker, Nutcracker Soldier on horseback, Nutcracker set (13 cm), Santa in Sleigh ornament, Multicolor LED Gingerbread Ornament, MULTICOLOR LED SANTA SLEIGH ORNAMENT.
ARTICLE FIVE: RAFFLE PROCEDURE AND COLLECTION OF THE PRIZE.
Once the validity period mentioned in this regulation has concluded, the information of the Participants who meet the mentioned requirements will be collected.
6 winners of the prizes will be selected from among all those who participated (1 for each of the stores); the random drawing will take place on November 6, 2025, at the central offices of Ferretería EPA, S.A., where a Record/Affidavit will be drawn up before two (2) witnesses with the names of the winning participants and their respective alternates. In total, one (1) alternate per winner will be selected. This information may also be presented before a Public Notary so that they may certify compliance with the requirements and the process of the Promotion by drawing up a Notarial Act. The organizer reserves the right to modify the date of the raffle provided that the chances of being favored for each of the participants are not modified.
Afterward, the correct participation of the selected winner will be verified. In the event that they do not meet the requirements, the selected person will be disqualified, and the first alternate will be verified, following the same protocol, and so on until the alternate winners are exhausted. In the event that the participation meets all requirements, the winner will be contacted via a telephone call within a maximum period of one (1) business day. In case of not reaching the selected person within a maximum of 2 call attempts during this period, a voicemail will be left, and the winner must contact the promotions department no later than the day following the voicemail, through the Ferretería EPA telephone exchange at 2588-1145, Monday through Friday from 8 am to 3 pm. If the winner cannot be contacted after this, the next alternate winner will be contacted following the same protocol, and so on until the alternate winners are exhausted. Once all winners are confirmed, the announcement of the winners will be made. The winner will be announced starting November 10, 2025, provided that everything mentioned in this article has been verified; otherwise, the organizer reserves the right to modify the announcement date until all necessary data for publication are correctly verified. The winner will be announced only through the “EPA Costa Rica” Facebook page in a wall post.
After the Raffle has been carried out and the winner and/or beneficiary of the prize has been identified in accordance with this Regulation, once the winner has been contacted in the follow-up procedure by a representative of Ferretería EPA S.A., they will be indicated the place, date, and time for the delivery and collection of the corresponding Prize. In this sense, the winner must sign a receipt for their prize, in addition to a liability release document for Ferretería EPA S.A., where all the conditions that the Prize grants will be expressed, releasing the Sponsor from all liability for the use and/or consumption thereof. Likewise, the winning participant may not claim or request from Ferretería EPA S.A. any additional expenses generated by the collection of the Prize, such as transport or the cost associated with it in case they do not have the necessary means to transport and/or install it in the place they freely decide.
If the conditions established in this Regulation are not met, or if the necessary data verification of the official winner cannot be performed, an alternate winner will be automatically selected, and data verification and prize delivery will proceed taking into account the specifications of this Regulation.
If they do not do so, they will lose the right to the prize and will not be able to claim damages against Ferretería EPA S.A. resulting from the loss of the Prize. Said Prize CANNOT be transferred, as the object of the promotion is that the fan and/or follower who made the comment and presented their valid identity card be the beneficiary of the Prize. Likewise, the favored Participant freely and spontaneously authorizes Ferretería EPA S.A. to use their image rights and name in promotional campaigns and any type of advertising carried out by Ferretería EPA S.A., without being able to request any remuneration for it.
In the event of having accepted the Prize, if the Participant refuses to receive it or complete the respective paperwork for formalization, the beneficiary will lose their right to the Prize. A Notarial Act regarding these circumstances will be drawn up at the discretion of the Organizer. The awarding of any of the prizes will be conditioned upon compliance with applicable laws and regulations, as well as compliance with the provisions of this Regulation. The organizer reserves the right to disqualify and/or demand the return of the prizes awarded to those participants who directly or indirectly breach the terms and conditions previously established herein. If the winner does not demonstrate their willingness to accept these conditions, the organizers will not assume any type of responsibility, exonerating themselves from the obligation to allow participation and the delivery of a prize or benefit.

Each winner will receive 1 Promotional Kit. The Promotion is aimed at the general public. Therefore, manufacturers, distributors, resellers, and other persons considered as such who are part of the commercial business, as well as the production chain of Ferretería EPA, may not participate in this Promotion. Likewise, employees and representatives of the Organizer who may eventually be incorporated and identified during the Promotion may not participate, nor may employees of Overseas Logistics Operations S.A. (OLO) and Credix World S.A. up to the first degree of consanguinity or affinity.
ARTICLE SIX: USE OF IMAGE AND FINAL PROVISIONS.
In order to publicize the results of the Promotion, at the decision and discretion of the Organizer, the participant who is favored with the prize of this Promotion expressly authorizes the Organizer for their name and image to appear in publications and other advertising media and, in general, in all disclosure material for activities subsequent to the Promotion, such as the delivery and receipt of prizes, without this implying additional remuneration or compensation, nor claims for image rights. By participating, they adhere to the regulations of this Regulation and may not refuse the disclosure of their information and image rights.
It is stated that all illustrations and/or photographs used corresponding to the prize in the publications of this Promotion correspond to the reality of what is offered and promoted by Ferretería EPA. If the selected Participant does not appear to redeem their prize within the period indicated in this Regulation, it will be considered a voluntary waiver of their right to claim the prize. The selected Participant will not have the right to any claim or compensation, not even partially, which each Participant accepts by voluntarily adhering to the participation in the promotion. If such a situation occurs, the Organizer is authorized to select an alternate winner as appropriate.
Ferretería EPA, S.A. will collect certain confidential information of the Participant, including but not limited to their personal data in accordance with the provisions of the “Law for the Protection of Individuals with regard to the Processing of their Personal Data” and its Regulations. Therefore, at the time of selection as a Winner or Beneficiary, the Participant must sign all documents that the Organizer determines to authorize Ferretería EPA, S.A. to collect and generally use their data in order to communicate as the winner of the Promotion.
Likewise, in special cases that warrant it, at the decision of the Sponsor, a Notarial Act will be drawn up regarding these circumstances to certify any fact not provided for in this Regulation.
In the event that they are the Winner and for whatever reason—whether they do not meet the conditions regulated herein or by their own will do not accept the Prize—they may not claim any indemnification or consolation prize from the Organizer, as it is not regulated by this Promotion.
The Promotion and the Participants are subject to the requirements, conditions, and restrictions of this Regulation.
In the event of any case of force majeure or acts of God, Ferretería EPA S.A. may suspend the Promotion in whole or in part, without generating any liability for said suspension.
Ferretería EPA S.A. will not be responsible for the collateral expenses that the Participant incurs in carrying out the proceedings to make this Promotion effective. These collateral expenses refer to: cost of calls, preparation of documents, copies, transport costs, among others.
Ferretería EPA S.A. reserves the right to suspend the benefits of this Promotion in cases where it is determined that its benefits have been applied through deceit, fraud, or other illegal activity.
The mechanics of this Promotion, as well as the Intellectual Property derived from it, are the exclusive property of Ferretería EPA S.A.
The responsibility of Ferretería EPA S.A. ends with the delivery of the Prize to the winning Participant; therefore, the organizer is responsible only for the delivery of the prize indicated in this Regulation.
The winner of the prize will be responsible for the use and enjoyment they make of it.
The Organizer will not be responsible for any unauthorized human intervention by third parties in computer systems or similar that alter the development of the promotion; therefore, if any such situation is detected, the Promotion will be suspended.

For the purposes of communicating this Regulation, the promotional material will establish the following legends: “Restrictions and conditions apply according to the ‘Promotional Kit Raffle’ Promotion Regulation.”
