Official Rules for the “Raspas” Promotion

This Regulation (hereinafter the “Regulation”) aims to establish, define, and limit the terms and conditions of the promotion to be carried out by FERRETERÍA EPA S.A., legal entity identification number 3-101-354271, which hereinafter and for the purposes of this Regulation shall be referred to as “The Organizer” and/or “Ferretería EPA S.A.”.

The provisions herein shall be mandatory for Participants (see definition of Participant below) in said Promotion. Participation in the Promotion implies the Participant's acceptance to comply with the rules and procedures, which are known and accepted as final by the Participants. Any breach of this Regulation implies the immediate exclusion of the Participant, without any liability on the part of Ferretería EPA S.A.

FIRST ARTICLE: GENERAL PROVISIONS AND NAME OF THE PROMOTION.

The name of this Promotion will be “RASPAS” (SCRATCH-OFFS), which hereinafter and for the purposes of this Regulation shall be referred to as the “Promotion”.

The Promotion Regulation will be disseminated in the regulations section of Ferretería EPA on Epaenlinea.com, without prejudice to Ferretería EPA S.A. freely choosing another additional advertising medium to disseminate the promotion.

The Promotion shall be governed by the conditions indicated below. By the mere fact of participating in the Promotion, Participants accept the rules established in this Regulation, including those clauses that limit the liability of the Organizers, which have been duly informed to the Participant.

SECOND ARTICLE: TERM OF THE PROMOTION

This Promotion is for a limited time, starting on Monday, February 2, from 7:00 am and ending on Monday, April 6, at 11:59 pm, or until supplies last, whichever occurs first.

THIRD ARTICLE: PURPOSE OF THE PROMOTION

To participate and be a beneficiary of the Promotion, it is necessary for the Participant to know and accept in advance the conditions and requirements established in this Regulation, which may be explained in a general manner by the Ferretería EPA Promotions Manager; likewise, the Participant and any interested party may make inquiries via the email promociones@cr.epa.biz. Any failure to comply with the Regulation and/or the procedures, mechanics, and systems for the application of the Promotion implies the immediate exclusion of the Participant from the Promotion and the revocation of any right or prize granted.

Persons interested in participating in the Promotion may do so in the manner described in the following articles:

The object of the Promotion is to offer the public the benefit of being favored as a winner of the prize that is the object of this Promotion, in accordance with the mechanics that will be indicated below. The Participant must accept the terms and conditions of this Regulation.

The Promotion will take place at the Curridabat, Belén, Escazú, Tibás, Desamparados, and Cartago stores.

THIRD ARTICLE-A: MECHANICS OF THE PROMOTION

In addition to what is described above, the promotion will be carried out as follows:

By purchasing one (1) gallon or one (1) bucket of the brands Innova Plus, Máxima Armor, Acrilatex, or Goltex plus a painting accessory (See Annex I for details of participating items).

The items must be on the same purchase invoice; subsequently, the customer must go to the customer service area with the purchase invoice and claim a scratch-off card, with which they will obtain instant prizes. (See Annex I to consult prizes).

There are 2 types of scratch-off cards, which correspond to a gallon or bucket; all cards will be awarded prizes, and a total of 4,000 prizes will be given out during the validity period or until supplies last, whichever happens first (See Annex 2 to consult prizes).

The customer may take as many scratch-offs as they wish if they include the same amount of paint and accessories on the invoice.

Ferretería Epa S.A. reserves the right to demand from the Participant any additional document that may be necessary to apply for the Promotion. In accordance with what is regulated herein, during the validity period of this Promotion, Participants who wish to participate in the draw will do so in accordance with the mechanics expressed in this Regulation.

FOURTH ARTICLE: DEFINITIONS

The terms indicated below shall have the meaning established, with the understanding that said meaning shall be applicable to both the singular and plural forms thereof.

1. “Customer or Participant”: any of the natural or legal persons who participate in the Promotion with the limitations indicated in this Regulation.

2. “Point of Sale”: means each of the stores in Curridabat, Escazú, Belén, Tibás, Desamparados, and Cartago.

3. “Personal Data”: (i) Full Name (first and last names); (ii) Valid and up-to-date personal identification number, duly recognized by the Government of the Republic of Costa Rica; (iii) Phone numbers; (iv) email address, in compliance with the legal provisions established by the “Law for the Protection of the Individual Regarding the Processing of their Personal Data”.

FIFTH ARTICLE: RESTRICTIONS AND LIMITATION OF LIABILITY:

Those customers who do not comply with one or more of the requirements indicated in this regulation will be excluded as participants. Likewise, if the data provided is not clear and does not allow the Participant to be identified.

For each beneficiary of a promotional benefit in accordance with the Third Article of this Regulation, the benefit will be applied instantly upon making the purchase at any point of sale; the benefit cannot be exchanged for cash and is valid until April 6, 2026.

Each participant must make the purchase during the promotion's validity period. Failure to do so will result in the loss of the right to it, and the Participant may not claim the loss of said benefit from Ferretería EPA S.A.

SIXTH ARTICLE: USE OF IMAGE AND FINAL PROVISIONS.

In order to make the results of the Promotion public, at the decision and discretion of the Organizer, the participant who is favored with the prize of this Promotion expressly authorizes the Organizer for their name and image to appear in publications and other advertising media, and in general in all dissemination material for activities subsequent to the Promotion, such as the delivery and receipt of the prizes, without implying remuneration or additional compensation, nor claims for image rights; therefore, by participating, they adhere to the regulations of this Regulation and may not refuse the disclosure of their information and image rights.

It is stated that all illustrations and/or photographs used corresponding to the prize in the publications of this Promotion correspond to the reality of what is offered and promoted by Ferretería EPA. If the selected Participant does not appear to redeem their prize within the period indicated in this Regulation, it shall be considered a voluntary waiver of their right to claim the prize. The selected Participant will not have the right to any claim or compensation, not even partially. If such a situation occurs, the Organizer is authorized to select a substitute winner as appropriate.

Ferretería EPA, S.A. will collect certain confidential information of the Participant, including but not limited to their personal data, in accordance with the provisions of the “Law for the Protection of the Individual Regarding the Processing of their Personal Data” and its Regulation, therefore, at the time of selection as a Winner or Beneficiary, the Participant must sign all documents determined by the Organizer to authorize Ferretería EPA, S.A. to collect and, in general, use their data for the purpose of communicating with them as the winner of the Promotion.

Likewise, in special cases that merit it, at the decision of the Sponsor, a Notarial Act will be drawn up regarding these circumstances to record any event outside what is foreseen in this Regulation.

In the event that a Winner results and for any reason, whether they do not meet the conditions regulated herein or of their own volition do not accept the Prize, they may not claim any compensatory sum or a consolation prize from the Organizer, as it is not regulated by this Promotion.

The Promotion and the Participants are subject to the requirements, conditions, and restrictions of this Regulation.

In the event of any situation of force majeure or acts of God, Ferretería Epa S.A. may totally or partially suspend the Promotion, without generating any liability for such suspension.

Ferretería Epa S.A. will not be responsible for the collateral expenses that the Participant incurs in carrying out the actions to make this Promotion effective. These collateral expenses refer to: cost of calls, preparation of documents, copies, cost of transportation, among others.

Ferretería Epa S.A. reserves the right to suspend the benefits of this Promotion in cases where it is determined that the benefits have been applied through deception, fraud, or other illegal activity.

The mechanics of this Promotion, as well as the Intellectual Property derived from it, are the exclusive property of Ferretería Epa S.A.

The responsibility of Ferretería Epa S.A. ends with the delivery of the Prize to the favored Participant, so the organizer is only responsible for the delivery of the prize indicated in this Regulation.

The winner of the prize will be responsible for the use and enjoyment they make of it.

The Organizer will not be liable for any unauthorized human intervention by third parties in computer systems or similar that alter the development of the promotion; therefore, in the event that any such situation is detected, the Promotion will be suspended.

For the purposes of communicating this Regulation in promotional material, the following legends will be established: “Restrictions and conditions apply according to the “Raspas” Promotion Regulation.”
