Official Rules for the “Grills” Promotion

This Regulation (hereinafter the “Regulation”) aims to establish, define, and limit the terms and conditions of the promotion to be carried out by FERRETERÍA EPA S.A., legal entity ID 3-101-354271, who hereinafter and for the purposes of this Regulation shall be referred to as “The Organizer” and/or “Ferretería EPA S.A.”.

The provisions herein shall be mandatory for Participants (see definition of Participant below) in said Promotion. Participation in the Promotion implies the Participant's acceptance to comply with the rules and procedures, which are known and accepted as final by the Participants. Any breach of this Regulation implies the immediate exclusion of the Participant, without any liability on the part of Ferretería EPA S.A.

ARTICLE ONE: GENERAL PROVISIONS AND NAME OF THE PROMOTION.

The name of this Promotion shall be “grills” (parrillas), which hereinafter and for the purposes of this Regulation shall be referred to as the “Promotion”.

The Promotion Regulation will be disseminated in the regulations section of Ferretería EPA at Epaenlinea.com, without prejudice to Ferretería EPA S.A. freely choosing any additional advertising medium to promote the campaign.

The Promotion shall be governed by the conditions indicated below. By the mere fact of participating in the Promotion, Participants accept the rules established in this Regulation, including those clauses that limit the liability of the Organizers that have been duly informed to the Participant.

ARTICLE TWO: DURATION OF THE PROMOTION

This Promotion is for a limited time, starting on Thursday, November 6th at 7:00 am and ending on Monday, December 22nd at 9:00 pm, or until stock runs out, whichever happens first.

ARTICLE THREE: OBJECTIVE OF THE PROMOTION

To participate and be a beneficiary of the Promotion, it is necessary for the Participant to know and accept in advance the conditions and requirements established in this Regulation, which may be explained in a general manner by the Ferretería EPA Promotions Manager. Likewise, the Participant and any interested party may make inquiries to the email promociones@cr.epa.biz. Any breach of the Regulation and/or the procedures, mechanics, and systems for applying the Promotion implies the immediate exclusion of the Participant from the Promotion and the revocation of any right or prize granted.

Persons interested in participating in the Promotion may do so in the manner described in the following articles:

The objective of the Promotion is to offer the public the benefit of being favored as the winner of the prize that is the object of this Promotion, in accordance with the mechanics that will be indicated below. The Participant must accept the terms and conditions of this Regulation.

The Promotion will take place in the Curridabat, Belén, Escazú, Tibás, Desamparados, and Cartago stores.

ARTICLE THREE-A: PROMOTION MECHANICS

In addition to what is described above, the promotion will be carried out in the following manner:

For the purchase of one (1) selected grill plus one grill accessory (See Annex I for details on participating items), the customer will have the option to draw a paper from the raffle drum located at customer service and win an instant prize.

The items must be on the same purchase invoice; subsequently, the customer must go with the purchase invoice to the customer service area and draw a paper from the raffle drum, with which they will obtain instant prizes. (See Annex I to consult prizes).

All papers will be winning, and a total of 1,800 prizes will be awarded during the validity period or until stock runs out, whichever happens first (See Annex 2 to consult prizes).

Ferretería EPA S.A. reserves the right to demand from the Participant any additional document that may be necessary to apply for the Promotion. In accordance with what is regulated herein, during the validity period of this Promotion, Participants who wish to participate in the draw will do so in accordance with the mechanics expressed in this Regulation.

ARTICLE FOUR: DEFINITIONS

The following terms indicated below shall have the meaning established, with the understanding that said meaning shall be applicable to both the singular and plural forms thereof.

1. “Customer or Participant”: any natural or legal person participating in the Promotion with the limitations indicated in this Regulation.

2. “Point of Sale”: means each of the stores in Curridabat, Escazú, Belén, Tibás, Desamparados, and Cartago.

3. “Personal Data”: (i) Full Name (first and last names); (ii) Valid and up-to-date personal identification number, duly recognized by the Government of the Republic of Costa Rica; (iii) Phone numbers; (iv) email address, in compliance with the legal provisions established by the “Law for the Protection of Individuals with regard to the Processing of their Personal Data”.

ARTICLE FIVE: RESTRICTIONS AND LIMITATION OF LIABILITY:

Those customers who do not meet one or more of the requirements indicated in this regulation will be excluded as participants. Likewise, if the data provided is not clear and does not allow the Participant to be identified.

For each person favored with a promotional benefit according to Article Three of this Regulation, the benefit will be applied instantly upon making the purchase at any point of sale; the benefit cannot be exchanged for cash and is valid until December 22, 2025.

Each participant must make the purchase during the promotion's validity. Failing to do so, they will lose the right to it and will not be able to claim from Ferretería EPA S.A. the loss of said object benefit.

ARTICLE SIX: USE OF IMAGE AND FINAL PROVISIONS.

In order to make the results of the Promotion public, at the Organizer's decision and discretion, the participant who is favored with the prize of this Promotion expressly authorizes the Organizer for their name and image to appear in publications and other advertising media and, in general, in all material for the disclosure of activities subsequent to the Promotion, such as the delivery and receipt of the prizes, without implying additional remuneration or compensation, nor claims for image rights. Therefore, by participating, they adhere to the regulations of this Regulation and cannot refuse the disclosure of their information and image rights.

It is stated that all illustrations and/or photographs used corresponding to the prize in the publications of this Promotion correspond to the reality of what is offered and promoted by Ferretería EPA. If the selected Participant does not appear to redeem their prize within the period indicated in this Regulation, it shall be considered a voluntary waiver of their right to claim the prize. The selected Participant will not have the right to any claim or indemnity, not even partially. Should such a situation arise, the Organizer is authorized to select a substitute winner as appropriate.

Ferretería EPA, S.A. will collect certain confidential information from the Participant, including but not limited to their personal data in accordance with the provisions of the “Law for the Protection of Individuals with regard to the Processing of their Personal Data” and its Regulation. Therefore, at the time of selection as a Winner or Favored party, the Participant must sign all documents that the Organizer determines, to authorize Ferretería EPA, S.A. to collect and, in general, use their data for the purpose of being able to contact them as the winner of the Promotion.

Likewise, in special cases that warrant it, at the Sponsor's decision, a Notarial Act will be drawn up for these circumstances to certify any fact beyond what is provided for in this Regulation.

In the event that they turn out to be the Winner and for whatever reason—whether they do not meet the conditions regulated herein, or of their own volition they do not accept the Prize—they will not be able to claim any indemnity sum or a consolation prize from the Organizer, as such is not regulated by this Promotion.

The Promotion and the Participants are subject to the requirements, conditions, and restrictions of this Regulation.

In the event of any case of force majeure or acts of God, Ferretería EPA S.A. may suspend the Promotion in whole or in part, without generating any liability for said suspension.

Ferretería EPA S.A. will not be responsible for any collateral expenses that the Participant may incur in carrying out the actions to make this Promotion effective. These collateral expenses refer to: cost of calls, preparation of documents, copies, transport costs, among others.

Ferretería EPA S.A. reserves the right to suspend the benefits of this Promotion in those cases where it is determined that the benefits thereof have been applied through deception, fraud, or other illegal activity.

The mechanics of this Promotion, as well as the Intellectual Property derived from it, are the exclusive property of Ferretería EPA S.A.

The responsibility of Ferretería EPA S.A. ends with the delivery of the corresponding Prize to the favored Participant; therefore, the organizer is responsible only for the delivery of the prize indicated in this Regulation.

The prize winner will be responsible for the use and enjoyment they make of it.

The Organizer will not be responsible for any unauthorized human interventions by third parties in the computer systems or similar that alter the development of the promotion; therefore, in the event that any such situation is detected, said Promotion will be suspended.

For the purposes of communicating this Regulation, the following legends will be established on the promotional material: “Restrictions and conditions apply according to the ‘Grills’ Promotion Regulation.”
