Official Rules for the “Stanley Engraving” Promotion
This Regulation (hereinafter the “Regulation”) aims to establish, define, and limit the terms and conditions of the promotion to be carried out by FERRETERÍA EPA S.A., legal entity number 3-101-354271, which hereinafter and for the purposes of this Regulation shall be referred to as “The Organizer” and/or “Ferretería EPA S.A.”.
The provisions herein shall be mandatory for the Participants (see definition of Participant below) in said Promotion. Participation in the Promotion implies the Participant's acceptance of complying with the rules and procedures, which are known and accepted as final by the Participants. Any breach of this Regulation implies the immediate exclusion of the Participant, without any liability on the part of Ferretería EPA S.A.
ARTICLE ONE: GENERAL PROVISIONS AND NAME OF THE PROMOTION.
The name of this Promotion will be “Stanley Engraving,” which hereinafter and for the purposes of this Regulation will be referred to as the “Promotion.”
The Promotion Regulation will be published in the regulations section of Ferretería EPA on Epaenlinea.com, without prejudice to Ferretería EPA S.A. freely choosing any additional advertising medium to promote the event.
The Promotion shall be governed by the conditions indicated below. By the mere fact of participating in the Promotion, Participants accept the rules established in this Regulation, including those clauses that limit the liability of the Organizers, which have been duly informed to the Participant.
ARTICLE TWO: PROMOTION PERIOD
The Promotion will take place only during the day and at the store where the Stanley activation is held, according to the schedule previously established by the Organizer and the Supplier. Which is detailed below:
December 20 – Escazú
December 21 – Belén
This will be during the hours of 9:00 am to 4:00 pm
Once the activation in each store is finished, the validity of the Promotion will end.
ARTICLE THREE: PURPOSE OF THE PROMOTION
To participate and be a beneficiary of the Promotion, it is necessary for the Participant to know and accept in advance the conditions and requirements established in this Regulation, which may be explained in a general manner by the Promotions Manager of Ferretería EPA. Likewise, the Participant and any interested party may make inquiries to the email promociones@cr.epa.biz. Any breach of the Regulation and/or the procedures, mechanics, and application systems of the Promotion implies the immediate exclusion of the Participant from the Promotion and the revocation of any right or prize granted.
Those interested in participating in the Promotion may do so under the modality described in the following articles:
The purpose of the Promotion is to offer the public the opportunity to be favored as a beneficiary of the service object of this Promotion, in accordance with the mechanics indicated below. The Participant must accept the terms and conditions of this Regulation.
The Promotion will take place in the Curridabat, Belén, Escazú, Tibás, Desamparados, and Cartago stores.
ARTICLE THREE-A: PROMOTION MECHANICS
In addition to what is described above, the promotion will be carried out in the following manner:
The customer must purchase Stanley brand products at the EPA store where the activation is being held, solely during the date of the event.
The customer may go to the area designated by the supplier to request the free engraving of participating hand tools (see annex 1).
There is no limit to the quantity of items per customer.
Only tools or products permitted according to the supplier’s specifications, indicated in the activation presentation, may be engraved:

Almost all hand tools and materials can be engraved.

The following CANNOT be engraved:
-
Storage and polyester organization accessories (backpacks, tote bags, tool belts not made of leather)
-
Sockets, due to their size
The benefit applies only to Stanley items purchased that same day at the store where the activation is taking place.
To apply for the benefit, the customer must present their purchase receipt from that day.
Ferretería EPA S.A. reserves the right to require the Participant to provide any additional document necessary to participate in the Promotion. In accordance with what is regulated herein, during the validity period of this Promotion, Participants who wish to participate in the drawing will do so in accordance with the mechanics expressed in this Regulation.
ARTICLE FOUR: DEFINITIONS
The following terms indicated below shall have the meaning established, with the understanding that said meaning shall be applicable to both the singular and plural forms thereof.

“Customer or Participant”: Natural or legal person who acquires Stanley products under the indicated conditions.

Point of Sale: EPA store where the Stanley activation is executed on the corresponding date.

“Point of Sale”: means each of the stores in Curridabat, Escazú, Belén, Tibás, Desamparados, and Cartago.

“Personal Data”: (i) Full Name (first and last names); (ii) Valid and up-to-date personal identification number, duly recognized by the Government of the Republic of Costa Rica; (iii) Telephone numbers; (iv) Email address, in compliance with the legal provisions established by the “Law for the Protection of Individuals with Regard to the Processing of their Personal Data.”
ARTICLE FIVE: RESTRICTIONS AND LIMITATION OF LIABILITY:
Those customers who do not comply with any or all of the requirements indicated in this regulation will be excluded as participants. Likewise, if the provided data is not clear and does not allow for the identification of the Participant.
The benefit is not exchangeable for money, credit, discounts, or other benefits.
The engraving only applies to Stanley products purchased on the day of the activation at the corresponding store.
Ferretería EPA S.A. is not responsible for damages or alterations subsequent to the engraving, as the use of the item remains the responsibility of the Participant.
ARTICLE SIX: IMAGE USE AND FINAL PROVISIONS.
In order to make the results of the Promotion public, at the decision and discretion of the Organizer, the participant who is favored with the prize of this Promotion expressly authorizes the Organizer for their name and image to appear in publications and other advertising media and, in general, in all disclosure material for activities subsequent to the Promotion, such as the delivery and receipt of prizes, without this implying additional remuneration or compensation, nor claims for image rights, so by participating, they adhere to the regulations of this Regulation and cannot refuse the disclosure of their information and image rights.
It is stated that all illustrations and/or photographs used corresponding to the prize in the publications of this Promotion correspond to the reality of what is offered and promoted by Ferretería EPA. If the selected Participant does not appear to claim their prize within the period indicated in this Regulation, it will be considered a voluntary waiver of their right to claim the prize. The selected Participant shall have no right to any claim or indemnity, even partially.
Ferretería EPA, S.A. will collect certain confidential information from the Participant, including but not limited to their personal data in accordance with the provisions of the “Law for the Protection of Individuals with Regard to the Processing of their Personal Data” and its Regulations, so that at the time of selection as a beneficiary or Favored Party, the Participant must sign all documents that the Organizer determines to authorize Ferretería EPA, S.A. to collect and, in general, use their data for the purpose of being able to contact them as a beneficiary of the Promotion.
Likewise, in special cases that warrant it, at the decision of the Sponsor, a Notarial Act will be drawn up regarding these circumstances to record any fact outside of what is provided for in this Regulation.
In the event that a person is a beneficiary and for any reason, whether they do not comply with the conditions regulated herein, or of their own volition they do not accept the Prize, they may not claim any indemnity sum or consolation prize from the Organizer, as it is not regulated by this Promotion.
The Promotion and the Participants are subject to the requirements, conditions, and restrictions of this Regulation.
In case of any fortuitous event or force majeure, Ferretería EPA S.A. may suspend the Promotion in whole or in part, without generating any liability for said suspension.
Ferretería EPA S.A. will not be responsible for the collateral expenses that the Participant may incur to carry out the procedures to make this Promotion effective. These collateral expenses refer to: cost of calls, preparation of documents, copies, transportation costs, among others.
Ferretería EPA S.A. reserves the right to suspend the benefits of this Promotion in cases where it is determined that the benefits thereof have been applied through deception, fraud, or other illegal activity.
The mechanics of this Promotion, as well as the Intellectual Property derived therefrom, are the exclusive property of Ferretería EPA S.A.
The responsibility of Ferretería EPA S.A. ends with the delivery of the Prize to the favored Participant, so the organizer is responsible only for the delivery of the prize indicated in this Regulation.
The prize beneficiary will be responsible for the use and enjoyment they give to it.
The Organizer will not be liable for any unauthorized human intervention by third parties to computer systems or similar that alter the development of the promotion, so if any similar situation is detected, said Promotion will be suspended.

For the purposes of communicating this Regulation, the promotional material will establish the following legends: “Restrictions and conditions apply according to the ‘Stanley Engraving’ Promotion Regulation.”
