OFFICIAL RULES FOR THE “EPA 2021 Construction Discussion” Dynamic

This Regulation (hereinafter the "Regulation") aims to establish, define, and limit the terms and conditions of the promotion to be carried out by FERRETERÍA EPA SA, corporate ID number 3-101-354271, which will hereinafter be referred to as "The Organizer" and/or "Ferretería Epa" for the purposes of this Regulation.
The provisions herein shall be mandatory for the Participants (see definition of Participant below) in said Promotion. Participation in the Promotion implies the Participant's acceptance to respect these rules and procedures, which shall be considered final with respect to the Promotion and are known and accepted as such. Any violation of these rules and/or procedures established for the Promotion will result in the immediate exclusion of the Participant, without any liability on the part of Ferretería EPA SA.

FIRST ARTICLE: GENERAL PROVISIONS AND NAME OF THE PROMOTION.
The name of this Promotion will be “Conversatorio construcción EPA 2021” (EPA Construction Forum 2021), which will hereinafter be referred to as the “Promotion” for the purposes of this Regulation.
The Promotion Regulation will be published on the official website of Ferretería Epa SA (www.epaenlinea.com), without prejudice to Ferretería EPA SA freely choosing any other additional advertising medium to publicize the promotion.
The purpose of this Regulation is to establish, regulate, limit, and clarify the guidelines and/or conditions under which the Promotion, which belongs to and is sponsored by Ferretería EPA SA, will be governed.
The Promotion will be governed by the following rules and conditions. By the mere fact of participating in the Promotion, Participants unconditionally accept all the rules expressed in this Regulation, including those clauses that limit the liability of the Organizers as duly informed to the Participant. Likewise, they agree to submit to the decisions of the organizers on any matter related to the promotion, which will be duly informed and communicated by the same means of advertising to all Consumers.

SECOND ARTICLE: TERM OF THE PROMOTION
This Promotion is for a limited time and will take place on March 7, 2021. It will occur during the live broadcast of the forum “Architecture of the new normal” EPA Construction Season 2021, which will begin at 10:00 am via Facebook/Epacostarica.

Therefore, the term of its validity will be limited to the date indicated above.

THIRD ARTICLE: PURPOSE OF THE PROMOTION
To participate and be a beneficiary of this Promotion, it is necessary for the Participant to know and accept in advance all the conditions, requirements, and limitations established in this Regulation, which may be explained in a general manner by the Promotions Manager of Ferreteria EPA via email at promociones@cr.epa.biz, duly identified upon the inquiry of any interested follower. Any violation of this Regulation and/or the procedures, mechanics, and systems of application of the Promotion will imply the immediate exclusion of the Participant from the Promotion and the revocation of any right or prize granted by this Regulation.
During the validity period of this Promotion, duly delimited in the previous Article of this Regulation, those interested in participating in the Promotion may do so in the modality described in the following articles.
The purpose of the Promotion is to offer fans and/or followers of the Official Ferretería EPA Facebook Profile (www.facebook.com/epacostarica), persons registered in the database, and any interested party, without the need to make any purchase in any of the Ferretería EPA Stores, during the term of the Promotion, the benefit of being favored as the winner of the prize object of this Promotion, in accordance with the mechanics indicated below. The Participant (see definition of Participant in the Fourth Article of this Regulation) must accept the terms and conditions of this Regulation at all times.
The Promotion is designed to be carried out solely through the digital portal on the website, specifically: www.epaenlinea.com. In this sense, only those persons who enter the dynamic section of the workshops prepared during the validity of the promotion will be able to participate, so any other person who does not enter the aforementioned page will not be able to participate for the purpose of being a beneficiary of the prize.

THIRD ARTICLE-A: MECHANICS OF THE PROMOTION
In addition to what is described above, the promotion will be carried out as follows:

A live broadcast or Facebook live will be held through the Facebook profile, Facebook/Epacostarica, identified with the name “The architecture of the new normal," where users must enter the broadcast and remain as viewers for at least 30 minutes during the broadcast and watch the forum. In this way, the viewer will be participating in the random drawing for the prize detailed in this regulation.

The above must be done during the validity period established in the second article. Participants have the possibility of winning, solely for having competed and completed the requirements for their participation. As a limitation for all Participants, they may make one (1) or more comments; however, they will only be participating by the mere fact of having entered and witnessed at least 30 minutes of the forum for the purposes of being favored randomly in the drawing for this Promotion.
Ferretería Epa S.A. reserves the right to demand from the Participant any additional document or personal information that is necessary to apply for the Promotion. In accordance with what is regulated here, during the term of this Promotion, Participants who wish to participate in the drawing will do so in accordance with the mechanics expressed in this Regulation.

FOURTH ARTICLE. DEFINITIONS AND PARTICIPANTS
The following terms, as well as the definitions used in this Regulation, will have the meaning established with the understanding that such meaning will be applicable to both the singular and plural forms thereof.
1. “Client or Participant” means any of the natural persons who participate in the Promotion with the limitations indicated in this Regulation.
2. “Point of Sale” For this dynamic means the website www.epaenlinea.com.
3. “Personal Data” means the data provided in the survey to register and reserve a spot in the workshops. The data requested are (i) Full Name (first and last names); (ii) Valid and up-to-date personal identification number, duly recognized by the Government of the Republic of Costa Rica; (iii) Phone numbers; (iv) email address, in compliance with the legal provisions established by the Law for the Protection of the Individual Against the Processing of Their Personal Data. The use of the information provided by the participant is detailed in the sixth article of this regulation.
4-Prize: In this Promotion, there is 1 winner and one type of prize and/or benefit, one prize for each of the winners, described below:

Prize:

In this promotion, 1 type of prize will be awarded, which corresponds to one (1) winner from among all participants on the attendance list who meet the mentioned requirements.

The winner will be awarded as a prize (1) a credit balance to be consumed exclusively at Ferretería Epa through any physical store, called an "acreencia" (credit), in the amount of fifty thousand (50,000) colones, and it must be collected directly at a Ferretería Epa branch which will be selected by the organizer.

The Promotion is aimed at Clients, Followers of the Official Profile, and Final Consumers of Ferretería EPA S.A. Therefore, manufacturers, distributors, resellers, and other persons considered as such, who are part of the business line as well as the production chain of Ferretería EPA, may not participate in this Promotion. Likewise, collaborators and representatives of the Organizer who are eventually incorporated and identified during the Promotion, nor collaborators of OverseasLogisticsOperations S.A. (OLO) and CredixWorld S.A. up to the first degree of consanguinity or affinity, may not participate in the Promotion.

FIFTH ARTICLE: DRAWING PROCEDURE AND COLLECTION OF THE PRIZE.
Once the live broadcast “The architecture of the new normal” has ended, the email addresses of all those people who attended during the live broadcast from the beginning of the broadcast until the moment it finished will be collected.

The winner of the prize indicated in this Regulation will be selected from among all those who have participated. The random drawing will take place after the broadcast on March 9, 2021. This will be carried out at the central offices of Ferreterías EPA; the drawing will be conducted by those in charge of the Marketing Department. An Act/Sworn Statement must be drawn up regarding said situation before 2 witnesses, stating the name of the winning Participants and their respective substitutes, 2 substitutes. The organizer reserves the right to modify the mentioned date of the drawing for convenience, as long as the chances of being favored for each of the participants are not modified. In case of modifying the date, the new date will be published in advance through the social networks of Ferretería EPA.

Then, the data provided and the correct participation of the selected winner will be verified. In case they do not comply, the selected person is discarded and the first substitute is verified, following the same protocol, and so on until the substitute winners are exhausted. In the event that the participation meets all the requirements, the winner will be contacted via a telephone call within a maximum period of (3) business days. In the event that the selected person cannot be located within a maximum of 3 call attempts during this period, the next corresponding substitute winner will be contacted, following the same protocol, and so on until the substitute winners are exhausted. Once all winners are confirmed, the announcement of the winners will proceed. The first winner will be announced starting March 12, 2021, and at the latest, the deadline will be extended to March 15 to publish all winners. Provided that everything mentioned in this article has been verified, otherwise, the organizer reserves the right to modify the date of the announcement until all data necessary for the publication are correctly verified. The winner will be announced only via the “EPA Costa Rica” Facebook page in a wall post.

After the mentioned Drawing has been carried out and the respective favored person and/or winner of the prize has been identified, in accordance with the previous Articles of this Regulation, once the winner is contacted following the procedure by an EPA representative, they will be indicated the place, date, and time for the delivery, as well as the collection of the corresponding Prize. In this sense, the winning person must sign for the receipt of their prize or confirm the receipt in accordance via email if applicable, granting a release of liability to Ferretería EPA S.A. where all the limitations and conditions of the awarded Prize will be expressed, releasing the Sponsor from all liability for the use and/or consumption thereof. Likewise, the favored winner may not claim or request from Ferretería EPA S.A. any additional expense generated by the collection of the Prize, such as transport or the cost associated with it in case of not having the necessary means to transport and/or install it in the place they freely decide.
If the conditions established in this Regulation are not met or if it is not possible to carry out the necessary data verification of the official winner, a substitute winner will be automatically chosen, and the verification of data and delivery of the prize will proceed, taking into account the specifications of this Regulation.
The Winner must collect their Prize within a period not exceeding 1 month from the moment they are contacted by Ferretería EPA S.A. collaborators, at the hours, days, and place established to collect the previously agreed Prize.
Failure to do so will result in the loss of the right to it, and the winner will not be able to claim damages and/or losses from Ferretería EPA S.A. as a result of the loss of the Prize. Said Prize CANNOT be transferred under any circumstances to a relative, spouse, child, or third party, given that the purpose of the promotion is for the participant who complied with all the mentioned requirements to be the beneficiary of the Prize. Likewise, the favored Participant authorizes Ferretería EPA S.A., freely and spontaneously, to use their image rights and name in promotional campaigns and any type of advertising carried out by Ferretería EPA S.A., without being able to request any remuneration for it.
In the event of having accepted the Prize, but for any circumstance, the Participant refuses to receive it or to complete the respective paperwork for the formalization, the favored person will lose their right to the Prize. A Notarial Act will be drawn up regarding these circumstances at the discretion of the Organizer. The awarding of any of the prizes will be conditioned upon compliance with each and every one of the applicable laws and regulations, as well as compliance with the provisions of this Regulation. The organizer reserves the right to disqualify and/or demand the return of the prizes awarded to those participants who directly or indirectly breach the terms and conditions previously established herein. If the winner does not demonstrate their willingness to accept these conditions, the organizers will not assume any type of liability, exonerating themselves from the obligation to allow participation and the delivery of a prize or benefit.

SIXTH ARTICLE: USE OF IMAGE, DATABASE, AND FINAL PROVISIONS.

In order to be able to make the results of the Promotion public, at the decision and discretion of the Organizer, the participants who are favored with any of the Prizes of this Promotion expressly authorize the Organizer so that their project, name, and image appear in publications and other advertising media and, in general, in all disclosure material of the activities subsequent to the Promotion, such as delivery and receipt of the prizes, without implying additional remuneration or compensation, nor claims for image rights, so that by participating they adhere to the regulations of this Regulation, and cannot refuse the disclosure of their information and image rights.
It is noted that all illustrations and/or photographs used corresponding to the prize in the publications of this Promotion correspond to the reality of what is offered and promoted by Ferretería EPA. If a selected Participant does not appear to redeem their prize within the period indicated in this Regulation, it will be taken as a voluntary waiver of their right to claim the prize. The selected Participant will have no right to any claim or compensation, not even partially, which each Participant accepts by voluntarily adhering to participation in the promotion. If such a situation arises, the Organizer is authorized to select a substitute winner as appropriate.

Personal Information: All information provided by participants will belong to the Organizer and/or Co-organizer. Participants, by providing their data, authorize access to such information by the Organizers and its inclusion in a database if the Organizer sees fit, also authorizing the use of said database to send commercial information of the Organizing Company or third parties, as well as any commercial purpose that is not prohibited through any means of communication available to the organizer.

Relationship between the parties: No provision of this Promotion shall be interpreted as creating a relationship between the parties different from that which arises from normal trade. No participant in the Promotion, by the fact of being one, acquires the status of employee, representative, or agent of the Organizing company. With the fulfillment of the obligations established in this Regulation, the relationship between the parties will end in its entirety.

Participants acknowledge that the Organizer will not collect or process sensitive personal data. The data requested from the participant and which the law authorizes the Organizer to request will be used. By the mere fact of participating, participants accept and consent that the data regarding their names, photographs, and personal emails they have on their Facebook social network profiles or provided at any time of the Promotion be used by the Organizer.

Regarding the respect for the right of informational self-determination that assists individuals, the Organizer informs all participants of the Promotion of the existence of a database where the personal data requested in this Promotion, email address, telephone number, will be collected.

The information contained in the database that may be held by the Promotion will be for the use of the Organizer, and the Organizer is authorized to transfer such data to the company(ies) it deems pertinent. Participants and users declare to have been informed of the conditions regarding personal data protection described above, accepting and consenting to the automated processing thereof by the Organizer, in the form and for the purposes indicated in this section.
