Official Rules for the “Free Shopping” Promotion

This Regulation (hereinafter the “Regulation”) aims to establish, define, and limit the terms and conditions of the promotion to be carried out by FERRETERÍA EPA S.A., corporate tax ID 3-101-354271, a corporation domiciled at the intersection of San Rafael de Escazú, on the North side of the Próspero Fernández Highway, San José, Costa Rica, which shall be referred to hereinafter and for the purposes of this Regulation interchangeably as “The Organizer” and/or “Ferretería EPA S.A.”

The provisions established herein are mandatory for all Participants (see the definition of Participant below) in said Promotion.

Participation in the Promotion implies the Participant's knowledge of the applicable rules and procedures, which will be published on the page https://cr.epaenlinea.com/ and may be explained in general terms by the Ferretería EPA Promotions Manager. Likewise, the Participant and any interested party may make inquiries to the email address promociones@cr.epa.biz.

Any breach of the Regulation and/or the procedures, mechanics, and systems of application of the Promotion implies the immediate exclusion of the Participant from the Promotion and the revocation of any right or prize granted, without any liability on the part of Ferretería EPA S.A.

ARTICLE ONE: GENERAL PROVISIONS AND NAME OF THE PROMOTION.

This promotion "Free Purchases," hereinafter and for the purposes of this Regulation referred to as the “Promotion,” aims to offer customers of the Ferretería EPA branch located in Cartago 400 m East of the Zona Franca de la Lima, Cartago, on national route 2, Interamericana Sur highway, the opportunity to obtain a purchase order, in accordance with the guidelines and/or conditions established in this regulation, and indicated below.

The Promotion Regulation will be disseminated in the regulation section of Ferretería EPA on Epaenlinea.com, without prejudice to Ferretería EPA S.A. freely choosing another additional advertising medium to disseminate the promotion.

By the mere fact of participating in the Promotion, Participants accept the rules established in this Regulation, including those clauses that limit the liability of the Organizers duly informed to the Participant.

ARTICLE TWO: DURATION OF THE PROMOTION

This Promotion is for a limited time and applies exclusively to the Ferretería EPA Point of Sale located in Cartago, as follows:

The promotion is valid during Thursday, June 19, 2025, starting from 7:00 am and until Thursday, July 2, 2025, until 9:00 pm.

ARTICLE THREE: OBJECT OF THE PROMOTION

The object of this promotion is to offer any individual who makes purchases at the Ferretería EPA store, located specifically 400 m East of the Zona Franca de la Lima, Cartago, on national route 2, Interamericana Sur highway, the opportunity for a purchase order, through their voluntary participation in a virtual roulette that will be available in the store's checkout area, during the validity period of this promotion.

10 orders will be given away randomly each day, until reaching 140 purchase orders during the 14 days of the promotion's validity, with a limit of two hundred thousand colones (₡200,000) for each purchase order, in accordance with the mechanics and conditions established in the following articles.

ARTICLE FOUR: PROMOTION MECHANICS AND CONDITIONS

In addition to what is described above, the promotion will be carried out as follows:

For each purchase, after paying at the registers, the customer will have the opportunity to spin the digital roulette; if they are a winner, a credit will be generated for the amount of the purchase they just made, with a maximum amount of two hundred thousand colones (₡200,000). The roulette will spin and stop on one of the following options:

Free purchase: The customer will obtain a credit for the amount of the purchase they just made, with a maximum amount of two hundred thousand colones (₡200,000)

Keep participating: The customer must pay the total amount of their purchase.

10 free purchases will be drawn per day during the 14 days of the promotion's validity, for a total of 140 free purchases.

The "free purchase" prize is valid only for the purchase in progress at the time of spinning the roulette. It does not apply to future purchases.

The "free purchase" prize is not transferable or redeemable for cash.

In the event that the customer makes a purchase for a value greater than the amount available for "free purchases," they will receive the maximum established amount.

Ferretería EPA S.A. reserves the right to demand from the Participant any additional document that is necessary to apply for the Promotion.

In accordance with what is regulated herein, during the validity period of this Promotion, Participants who wish to participate in the draw will do so in accordance with the mechanics expressed in this Regulation.

ARTICLE FIVE: DEFINITIONS

The following terms indicated below shall have the established meaning, with the understanding that said meaning shall be applicable to both the singular and plural forms thereof.

1. “Customer or Participant”: any of the individuals who participate in the Promotion with the limitations indicated in this Regulation.
2. “Point of Sale”: means solely and exclusively the store in Cartago.
3. “Personal Data”: (i) Full Name (first and last names); (ii) Valid and up-to-date personal identification number, duly recognized by the Government of the Republic of Costa Rica; (iii) Phone numbers; (iv) email address, in compliance with the legal provisions established by the “Law for the Protection of Persons Regarding the Processing of their Personal Data.”
4. “Prize”: 140 purchase orders with a limit of one hundred thousand colones (₡100,000); 10 orders will be delivered daily.
5. Free purchase: It is the result of the individual prize, with a limit of 100,000 colones, valid only for the purchase in progress at the time of spinning the roulette. It does not apply to future purchases. The "free purchase" prize is not transferable or redeemable for cash. In the event that the customer makes a purchase for a value greater than the amount available for "free purchases," they must pay the difference. 10 free purchases will be drawn each day, until the full amount of the prize is covered.

ARTICLE SIX: DRAW PROCEDURE AND PRIZE COLLECTION.

During the validity mentioned in this regulation, the free purchases will be drawn in the checkout area by means of a virtual roulette.

10 winners will be selected from among all those who have participated; the prize must be redeemed at the place and time the draw was held; the person must be of legal age, provide their personal data on the purchase invoice, and this does not apply to corporate tax IDs.

After the aforementioned Draw has been carried out and the favored party and/or winner of the prize has been identified, in accordance with the previous Articles of this Regulation, once the winner has been chosen following the procedure by a representative of Ferretería EPA S.A., the mechanics for collecting the corresponding Prize will be indicated to them. In this sense, the winner must sign a receipt for their prize as proof, as well as a liability release document for Ferretería EPA S.A., where all the conditions granted by the Prize will be expressed, releasing the Sponsor from all liability for the use and/or consumption thereof. Likewise, the favored winner may not claim or request from Ferretería EPA S.A. any additional expense generated by the collection of the Prize, such as transport or the cost associated with it in the event that they do not have the necessary means to transport and/or install it in the place they freely decide.

If the conditions established in this Regulation are not met, or if it is not possible to verify the necessary data of the official winner, a substitute winner will be automatically chosen, and the verification of data and delivery of the prize will proceed, taking into account the specifications of this Regulation.

Failure to do so will result in the loss of the right to it, and the participant may not claim damages and/or losses from Ferretería EPA S.A. resulting from the loss of the Prize. Said Prize CANNOT be transferred, as the object of the promotion is for the fan and/or follower who made the comment and presented the valid identity card to be the beneficiary of the Prize. Likewise, the favored Participant freely and spontaneously authorizes Ferretería EPA S.A. to use their image and name rights in promotional campaigns and any type of advertising carried out by Ferretería EPA S.A., without being able to request any remuneration for it.

In the event that the Prize has been accepted and the Participant refuses to receive it or complete the respective paperwork for formalization, the favored party will lose their right to the Prize. A Notarial Act will be drawn up regarding these circumstances at the discretion of the Organizer. The awarding of any of the prizes will be conditioned upon compliance with applicable laws and regulations, as well as compliance with the provisions of this Regulation. The organizer reserves the right to disqualify and/or demand the return of the prizes awarded to those participants who directly or indirectly breach the terms and conditions previously established herein. If the winner does not demonstrate their willingness to accept these conditions, the organizers will not assume any type of responsibility, exonerating themselves from the obligation to allow participation and the delivery of a prize or benefit.

Single Paragraph: Each winner will receive 1 of the 10 free purchases. The Promotion is aimed at the general public. Therefore, manufacturers, distributors, resellers, and other persons considered as such, who are part of the commercial activity, as well as the production chain of Ferretería EPA, may not participate in this Promotion. Likewise, collaborators and representatives of the Organizer who may eventually be incorporated and identified during the Promotion, as well as collaborators of Overseas Logistics Operations S.A. (OLO) and Credix World S.A. up to the first degree of consanguinity or affinity, may not participate in the Promotion.

ARTICLE SEVEN: USE OF IMAGE AND FINAL PROVISIONS.

In order to make the results of the Promotion public, at the decision and discretion of the Organizer, the participant who is favored with the prize of this Promotion expressly authorizes the Organizer for their name and image to appear in publications and other advertising media and, in general, in all disclosure material for activities subsequent to the Promotion, such as the delivery and receipt of the prizes, without implying additional remuneration or compensation, nor claims for image rights, so that by participating, they adhere to the regulations of this Regulation and cannot refuse the disclosure of their information and image rights.

It is placed on record that all illustrations and/or photographs used corresponding to the prize in the publications of this Promotion correspond to the reality of what is offered and promoted by Ferretería EPA. If the selected Participant does not redeem their prize within the period indicated in this Regulation, it will be considered a voluntary waiver of their right to claim the prize. The selected Participant will have no right to any claim or indemnity, not even partially, which each Participant accepts by voluntarily adhering to the participation in the promotion.

Ferretería EPA, S.A. will collect certain confidential information from the Participant, including but not limited to their personal data in accordance with the provisions of the “Law for the Protection of Persons Regarding the Processing of their Personal Data” and its Regulation, so at the time of selection as Winner or Favored party, the Participant must sign all documents that the Organizer determines, to authorize Ferretería EPA, S.A. to collect and, in general, use their data for the purpose of communicating with them as the winner of the Promotion.

Likewise, in special cases that warrant it, at the decision of the Sponsor, a Notarial Act will be drawn up regarding these circumstances to place on record any event outside of what is provided for in this Regulation.

In the event that they are declared the Winner and for any reason, whether they do not meet the conditions regulated herein, or of their own volition do not accept the Prize, they may not claim from the Organizer any indemnity sum or a consolation prize, as it is not regulated by this Promotion.

The Promotion and the Participants are subject to the requirements, conditions, and restrictions of this Regulation.

In the event of any situation of fortuitous event or force majeure, Ferretería EPA S.A. may suspend the Promotion in whole or in part, without any liability being generated by such suspension.

Ferretería EPA S.A. will not be responsible for the collateral expenses that the Participant may incur to carry out the procedures to make this Promotion effective. These collateral expenses refer to: cost of calls, preparation of documents, copies, transport cost, among others.

Ferretería EPA S.A. reserves the right to suspend the benefits of this Promotion in cases where it is determined that the benefits of the same have been applied through deceit, fraud, or other illegal activity.

The mechanics of this Promotion, as well as the Intellectual Property derived from it, are the exclusive property of Ferretería EPA S.A.

The liability of Ferretería EPA S.A. concludes with the delivery of the corresponding Prize to the favored Participant, so the organizer is responsible only for the delivery of the prize indicated in this Regulation.

The winner of the prize will be responsible for the use and enjoyment they make of it.

The Organizer will not be responsible for any unauthorized human interventions by third parties to the computer systems or similar that alter the development of the promotion, so in case any similar situation is detected, said Promotion will be suspended.
