Rules for the "Interest Update in Our Database" promotion

This Regulation (hereinafter the “Regulation”) aims to establish, define, and limit the terms and conditions of the promotion to be carried out and organized by FERRETERÍA EPA S.A., legal entity registration number 3-101-354271, which shall be referred to hereinafter and for the purposes of this Regulation as “The Organizer” and/or Ferretería Epa S.A. / EPA.”

The provisions herein shall be mandatory for the Participants (see definition of Participant below) who, voluntarily and in compliance with these provisions, decide to participate in the Promotion carried out by EPA. Participation in the Promotion implies that the Participant acknowledges and respects these rules and procedures, which shall be considered final regarding the Promotion, and are known and accepted as final. Any violation of said rules and/or procedures established for the Promotion shall imply the immediate exclusion of the Participant, without any liability on the part of Ferretería EPA S.A., including the return of prizes granted under this Regulation, when there are reasonable grounds to believe that the participant is not purchasing products for personal use or for their family circle, with the intention of reselling or distributing them, or with the intention of purchasing the participating items for the sole purpose of participating in the Promotion and subsequently returning said products before the deadline of the same.

SECTION A. GENERAL PROVISIONS:

Article A1: Regarding the Promotion: The purpose of this Regulation is to establish, regulate, limit, and clarify the guidelines and/or conditions under which the Promotion named “Update your interests in our database” (hereinafter referred to as the “Promotion”) will be governed, which belongs to and is primarily sponsored by Ferretería EPA S.A. (hereinafter referred to as the “Sponsor” and/or “Organizer”).

Article A2: This Promotion is for a limited time, starting on October 5, 2021, and ending on October 31, 2021, thus establishing the validity period in accordance with this Regulation.

Article A3: Any natural or legal person who wishes to do so may participate in this Promotion; in the case of natural persons, provided they are of legal age and possess a valid and up-to-date personal identification document, duly recognized by the Government of the Republic of Costa Rica, given that the purpose of this Promotion is the benefit of EPA’s end customers and/or consumers.

Article A4: The Promotion is aimed at End Consumers of Ferretería EPA S.A. who are duly registered on the official website epaenlinea.com, or those who duly register during the validity period. The terms and conditions of use for the website are governed by the “Terms and conditions” of epaenlinea.com, which are available on the website itself or at this address: https://cr.epaenlinea.com/terminos-condiciones.

The Organizer reserves the right to disqualify from the Promotion or not to proceed with the delivery of the promotional benefit granted under this Regulation when there are reasonable grounds to believe that the participant is not purchasing products at EPA for their personal use or that of their family circle, with the intention of reselling or distributing them, or with the intention of purchasing the participating items for the sole purpose of participating in the Promotion and subsequently returning said products before the deadline of the same.

The fact that a person participates (2) times in the same month, which significantly exceeds what is reasonable and expected of an average contestant, will lead the Organizers to presume that their participation has been manipulated with the intent of increasing their probability of winning. The promotional benefit can only be used once, at the time of making a purchase on the epaenlinea.com portal.

Article A5: The following capitalized terms and definitions used in this Regulation shall have the meaning established, with the understanding that said meaning shall be applicable to both the singular and plural forms thereof.

  1. “Customer or Participant” means any natural person participating in the Promotion subject to the limitations of Articles A3 and A4 of this Regulation.
  1. “Points of Sale” means exclusively through purchases made on the digital platform epaenlinea.com.
  1. “Personal Data” means the data that each Participant must provide in order to participate, which are (i) Full Name; (ii) Valid and up-to-date personal identification number, duly recognized by the Government of the Republic of Costa Rica; (iii) Phone numbers; (iv) Purchase receipt number.
  1. Prize: In this promotion, there is one (1) type of prize, which consists of:

Promotional benefit: In this promotion, there is one prize per participant of a 10% discount coupon, which will be granted through a digital coupon for exclusive use on epaenlinea.com, which will be valid until November 15, 2021.

  1. General details of the prize: If selected to redeem the prize, you must select the products you wish to purchase exclusively through epaenlinea.com, add them to the shopping cart, and once in the payment methods section, you must type the alphanumeric code in the “Coupon” field and apply it to obtain the aforementioned discount prior to payment. The digital coupon code can only be used (1) time per user in a single purchase; therefore, the digital coupon will be consumed in its entirety regardless of the total amount of the purchase to which it is applied.
  2. Restrictions on use: Does not apply to other promotions (Opportunities or clearances) nor to category 30 (Construction).

Article A6: For more information or inquiries regarding this Regulation, you may call 800 EPAVALE (800-372 8253). This Regulation will be available in its entirety for the knowledge and information of the general public and consumers at epaenlinea.com during the validity of this promotion. For the purpose of communicating this Regulation, promotional material will state the following legal legends: (1) "Conditions apply, see regulation at epaenlinea.com. Validity to fill out the survey from October 5 to October 31, 2021. (2) "Conditions apply, see regulation at epaenlinea.com. Validity for coupon redemption until November 15, 2021.

SECTION B. PARTICIPATION MECHANICS AND CONDITIONS:

Article B1: To participate in this Promotion, it is necessary for the Participant to know and accept in advance the conditions, requirements, and limitations established in this Regulation, which will be explained if necessary by duly identified Ferretería EPA service advisors. Likewise, this Regulation will be available at Customer Service and on the official website epaenlinea.com. Any violation of this Regulation and/or the procedures, mechanics, and application systems of the Promotion will imply the immediate exclusion of the Participant from the Promotion and the revocation of any right or prize granted.

Article B2: During the validity period of this Promotion, duly delimited in Article A2 of this Regulation, those interested in voluntarily participating in the Promotion may do so in the manner described in the following Articles.

Article B3: During the validity period of this Promotion, Participants who wish to obtain the prize must do so as follows:

On October 5, 2021, an email will be sent to all customers registered in the Ferretería Epa database to request a data update in which they must select their interests. Among those who have correctly updated their interests by the end of the survey, they will obtain the promotional benefit that is the object of this promotion, which will have a maximum period until November 15, 2021, to redeem their prize. To participate, the customer registered in the database must check their inbox, Spam folder, or junk mail folder to ensure they access the survey provided by email before the established deadline; in the event that the selected individual does not open the aforementioned email or update the information requested in the survey, the customer will not be able to claim or enjoy the promotional benefit that is the object of this regulation.

Article B4: Conditions for participating.
